The CCMA (Commission for Conciliation, Mediation and Arbitration) is the independent statutory body that conciliates, mediates and arbitrates labour disputes in South Africa - most commonly unfair dismissal claims, but also disputes over unfair labour practices and certain pay disputes.
What it means
A dispute typically goes to conciliation first, where the CCMA tries to help the parties settle; if that fails, it can proceed to arbitration, where a commissioner issues a binding ruling. The CCMA operates outside the ordinary courts and is generally faster and cheaper for employees to access.
Where it fits in
Payroll disputes - underpayment, incorrect deductions, disputed final pay on termination - can end up at the CCMA if not resolved internally, making accurate payroll records and a documented payroll process valuable evidence if a case is referred.
