Public Officer (SARS)

The public officer is the individual a company appoints as its representative to SARS, personally responsible for the company's tax compliance.

Every company registered for income tax in South Africa must appoint a public officer - a natural person, usually a director or senior employee, who represents the company in its dealings with SARS.

What it means

The public officer is the person SARS holds accountable for the company's tax obligations being met - filing returns, responding to queries, and ensuring payments are made. It's an accountability role rather than a role with independent decision-making authority over the company.

Where it fits in

The public officer sits alongside payroll's own statutory contacts - the person who signs off EMP201 and EMP501 declarations may or may not be the same individual, but ultimate accountability to SARS for the company's tax affairs, including its PAYE compliance, rests with the public officer.
